Physician Transformation Institute (a 501(c)(3) nonprofit organization) (collectively, the "Company," "we," "our," or "us") knows that you care about how your personal information is used and shared. We take your privacy seriously and want to outline the measures we employ in safeguarding your personal information.

This Privacy Notice covers Company's treatment of information collected when you access the mobile application or any other linked pages, features, content, or application services offered from time to time by Company in connection therewith (collectively, the "Mobile App"). This Privacy Notice applies to information we collect:

on the Mobile App; or
in communications between you and the Mobile App.

If you do not agree with our policies and practices, you must stop using the Mobile App. By accessing or using the Mobile App or using any of our services, you acknowledge that you have read and accept the practices and policies outlined in this Privacy Notice, our Terms of Use, and any other Company policies or agreements in place at that time. We reserve the right to make changes to this Privacy Notice from time to time. Your continued use of this Mobile App after we make changes is deemed to be acceptance of those changes, so please check periodically for updates.

III. Users Must Be At Least 18

Users of our Mobile App must be at least 18 years old; any user under 18 is not authorized. Our Mobile App is not targeted to children under age 18. Additionally, we do not knowingly collect any personal information from children under 18 years of age.

If you have reason to believe that a child under the age of 18 has provided personal information to Company through this² Mobile App, please contact us, and we will endeavor to delete that information from our databases.³

IV. Information We Collect and How We Collect It

We collect several types of information from and about users of the Mobile ⁵App, primarily consisting of contact information and professional identifiers.

A. Information We Collect Directly From You

This includes information by which you may be personally identified ("personal information"), such as:

Identifiers: Name, e-mail address, and phone number (to create and manage your account and communicate with you).
Professional Information: Profession/Occupation history (for profile creation and to ensure relevance of content).
Account Information: Login credentials.
Billing Information: Credit card information and other payment processing information (to process transactions and fulfill orders).

B. Information Collected Automatically

Upon engaging the Mobile App, the Company automatically receives and records general usage information:

Usage Data: Details about your internet connection, the equipment you use to access our Mobile App, and Mobile App usage details.
Online Identifiers: IP address, the type of browser used, and cookie information (used only for analytics and maintenance).

We specifically confirm that we DO NOT collect Sensitive Personal Information, including precise geolocation data, health information, race, or religious beliefs.

How We Collect This Information:

Directly from you when you provide it to us, such as when you create an account, or contact us with inquiries.
Automatically as you use the Mobile App.

V. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

To Provide App Functionality: To provide the Mobile App and its contents to you; to register a user; and to fulfill any other purpose for which you provide it.
To Process Transactions: To process transactions and fulfill orders, including billing and collections.
Account Management: To provide you with notices about your account, promotions, or other agreements; and to carry out our obligations and rights arising from any contracts entered into between you and us.
Marketing and Communication: To provide you with information, opportunities, or services, including customer support, that you request from us.
Security and Legal: To defend against claims and litigation; to enforce our policies and protect against security incidents, including to prevent fraud, malicious, deceptive or illegal activity; and to enforce our policies.
For Analytics and Improvement: To analyze usage trends and improve the content and offerings of the Mobile App.
With Your Consent: For any purpose with your consent.

You may notify us to opt-out from receiving certain marketing emails, and each marketing email will include an opt-out button or unsubscribe link.

VI. Disclosure of Your Information

The Company does not sell or share your personal information to third parties for monetary or other valuable consideration, including for targeted advertising or marketing purposes.

We may disclose the personal information we collect or you provide in accordance with this Privacy Notice only under the following circumstances:

Affiliates and Service Providers: To our subsidiaries, affiliates, contractors, service providers, and vendors (e.g., payment processors, hosting providers) who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
Business Transfers: To a buyer or other successor in the event of a merger, divestiture, restructuring, or other sale or transfer of some or all of Company's assets.

We may also disclose aggregated or de-identified information that does not identify any individual without restriction.

VII. Data Security, Cookies, and Do Not Track

A. Data Security

No Internet or e-mail transmission is ever fully secure or error free. Your Company account personal information is protected by a password for your privacy and security. You are responsible for protecting against unauthorized access to your account and personal information. Any transmission of personal information is at your own risk.

B. Cookies and Usage Data

We use "cookies" and other tracking technologies only for session management, site function, and analyzing aggregated usage. This information is not used for targeted advertising.

C. Do Not Track

Because there is no common understanding of what a “Do Not Track” signal is supposed to mean, we will not respond to browser Do Not Track (DNT) signals.

VIII. Links to Other Web Sites and Social Media

This Privacy Notice applies only to the Mobile App. This Mobile App may contain links to other web sites or social media platforms (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. Any information that you post on social media is governed by each social platform’s privacy notices.

IX. Other Terms and Conditions

Your access to and use of this Mobile App is subject to the Mobile App’s Terms of Use.

X. International Transfers

Company will primarily store your information in the United States. If you are accessing or using our Mobile App or otherwise providing personal information to us, you are agreeing and consenting to the processing of your personal information in the United States.

XI. Your U.S. State Privacy Rights

A. Texas and Nonprofit Status

As a 501(c)(3) nonprofit organization incorporated in Texas, Physician Transformation Institute is generally exempt from the requirements of the comprehensive Texas Data Privacy and Security Act (TDPSA) and most other U.S. state comprehensive privacy laws (such as CCPA/CPRA, VCDPA, etc.).

B. Transparency and Exercising Your Rights

Although we are generally exempt, we are committed to transparently protecting your privacy. Because we do not sell or share personal information for targeted advertising, we already meet or exceed many core compliance requirements.

If you are a resident of a U.S. state with specific privacy rights (e.g., the right to know what data is collected or request deletion), you may contact us using the methods described in Section XII. We will review and respond to your request in accordance with applicable legal requirements.

XII. Your General Data Protection Regulation Rights

General Data Protection Regulation (“GDPR”) permits users who are in the European Economic Area (“EEA”), European Union (“EU”), and the United Kingdom (“UK”) to exercise certain data rights, including rights to access, rectification, erasure (the "right to be forgotten"), and to object to processing.

Transfer Your Information Out of the European Economic Area.

Any transfer of your personal information to the United States will be subject to applicable safeguards, such as Standard Contractual Clauses (SCCs), designed to help safeguard your privacy rights.
